Daho Collective Terms and Conditions
Last Updated: August 26, 2026
These Terms and Conditions (“Terms”) govern your access to and use of http://dahocollective.com and the certifications, examinations, educational materials, digital content, programs and other services offered through the website.
The Website and Daho Collective are operated by Consultation DMT Inc., a corporation based in Quebec, Canada.
By accessing the Website, creating an account, purchasing a product or service, enrolling in a certification or otherwise using our services, you agree to these Terms.
If you do not agree with these Terms, you should not use the Website or purchase or access our services.
1. Definitions
For purposes of these Terms:
“Daho Collective,” “we,” “us,” and “our” refer to Daho Collective and, where applicable, its operator, Consultation DMT Inc.
“Website” means http://dahocollective.com and the online services made available through it.
“User,” “you,” and “your” refer to any individual accessing or using the Website or our Services.
“Account” means a registered user account used to access Daho Collective Services.
“Services” includes certifications, examinations, educational programs, study materials, seminars, digital content and other products or services made available by Daho Collective.
“Content” means text, graphics, logos, photographs, videos, educational materials, study guides, examinations, questions, documents, certificates, software and other materials provided through Daho Collective.
2. Eligibility and Accounts
You must provide accurate, complete and current information when creating an Account or purchasing Services.
You are responsible for maintaining the confidentiality of your login credentials and for activity occurring through your Account.
You may not share your Account with another person or allow another individual to complete certification requirements, examinations or assessments using your Account.
If you believe your Account has been accessed without authorization, you should contact us promptly.
Certain Services may have additional eligibility requirements that will be disclosed before enrollment.
3. Purchases and Formation of Contract
Prices, applicable taxes, the description of the Service and any material restrictions or conditions will be presented before purchase.
By submitting an order, you offer to purchase the selected Service under these Terms and any additional terms disclosed during checkout.
A purchase is confirmed when payment is successfully processed and/or we provide confirmation of enrollment or purchase.
For online consumer transactions, Daho Collective will provide information and documentation required by applicable Quebec consumer-protection legislation.
Quebec’s online-purchase rules require merchants to disclose specified information before the transaction and provide consumers with an easily retained and printable copy of the contract within the prescribed period.
4. Pricing and Payment
Prices displayed on the Website are shown in the currency identified at checkout.
Applicable taxes and other charges will be disclosed where required before completion of the purchase.
Payments may be processed through third-party payment processors. By submitting payment information, you represent that you are authorized to use the selected payment method.
We reserve the right to modify prices for future purchases. A price change will not retroactively alter the price of a completed purchase except where permitted or required by law.
5. Refunds, Cancellations and Exchanges
Refund, cancellation and exchange conditions applicable to a particular Service will be disclosed before purchase where required.
Because certain Daho Collective products include immediate access to digital educational materials, certification content and/or examinations, refund eligibility may be limited once access has been provided or substantial use of the Service has occurred, subject always to rights that cannot legally be excluded or restricted.
Nothing in these Terms limits any cancellation, refund, chargeback or other consumer right provided by applicable law.
Daho Collective will honour any refund or cancellation policy expressly presented to you at the time of purchase.
This qualification matters in Quebec. Merchants can establish their own cancellation/refund policy in many circumstances, but they must disclose and follow it, and statutory cancellation rights can still arise if distance-contract requirements aren’t met.
6. Certification Programs
Enrollment in a Daho Collective certification does not guarantee certification.
Candidates must satisfy the requirements established for the applicable certification, including any required educational components, examinations, passing scores or other completion criteria.
Certification is awarded only to candidates who successfully satisfy the applicable requirements.
Daho Collective may establish and reasonably modify examination procedures, passing standards, assessment methods and certification requirements, provided changes are administered in accordance with applicable law and any commitments made to existing candidates.
7. Examination Integrity
Daho Collective certification examinations and assessment materials are confidential and proprietary.
Users must not:
copy, photograph, record, reproduce or distribute examination questions or answers;
publish examination content online or through social media;
share examination questions or answers with another person;
obtain or attempt to obtain unauthorized examination materials;
permit another individual to complete an examination on their behalf;
use another individual’s Account;
engage in cheating, impersonation, collusion or other conduct that compromises examination integrity.
Daho Collective may investigate suspected examination misconduct.
Where reasonably supported by the circumstances, violations may result in invalidation of examination results, suspension or termination of access, revocation of certification, or other appropriate action, subject to applicable law.
8. Certification Credentials
Certificates and certification identification numbers issued by Daho Collective are intended to identify individuals who have successfully completed the applicable certification requirements.
Certificates may not be altered, falsified, transferred or used by another person.
Users may accurately represent a valid certification they have earned but may not misrepresent their certification status, scope, qualifications or relationship with Daho Collective.
Daho Collective reserves the right to correct administrative errors involving certificates or certification records.
9. Professional Scope and Certification Disclaimer
Daho Collective provides professional education and certification.
Certification by Daho Collective does not constitute a medical licence, healthcare licence, government licence or authorization to practise a regulated profession.
Certified individuals remain responsible for understanding and complying with the laws, professional regulations, insurance requirements and scope-of-practice restrictions applicable in the jurisdiction where they provide services.
Daho Collective certification does not authorize a person to diagnose disease, prescribe medication, provide medical treatment or perform another regulated professional activity unless that person is independently authorized to do so.
10. Educational and Health Information Disclaimer
Content provided by Daho Collective is intended for educational and professional-development purposes.
Information concerning exercise, fitness, nutrition, health and wellness is not intended as individualized medical advice, diagnosis or treatment.
Users and professionals are responsible for exercising appropriate professional judgment and referring clients to qualified healthcare or other regulated professionals where appropriate.
No educational program can eliminate all risks associated with physical activity, exercise or health-related decision-making.
11. Intellectual Property
Unless otherwise stated, the Website, Daho Collective branding, certification materials, study guides, examination materials, videos, graphics, written materials, educational frameworks and other original Content are owned by or licensed to Consultation DMT Inc.
They are protected by applicable Canadian and international intellectual-property laws.
Purchasing or accessing Content grants you a limited, personal, non-exclusive, non-transferable right to use that Content for your own education and certification participation.
It does not transfer ownership of the Content or intellectual-property rights to you.
12. Prohibited Use of Content
Without our prior written authorization, you may not reproduce, distribute, sell, sublicense, publish, upload, transmit, modify, create unauthorized derivative works from, commercially exploit or make Daho Collective Content available to others.
You may not sell or redistribute study guides, certification materials, examination materials or other protected Content.
Nothing in these Terms restricts uses that are expressly permitted under applicable copyright law.
13. User Conduct
You agree not to use the Website or Services to engage in unlawful, fraudulent, abusive or harmful activity; interfere with the operation or security of the Website; attempt unauthorized access to Accounts or systems; impersonate another person; distribute malware; scrape or systematically extract protected Content without authorization; or violate another person’s intellectual-property, privacy or other legal rights.
We may restrict access when reasonably necessary to protect our Users, systems, certification integrity or legal rights.
14. Suspension and Termination
We may suspend or terminate an Account for material violations of these Terms, including fraud, unauthorized Account sharing, examination misconduct, unauthorized distribution of protected materials, abuse of our systems or other serious misuse.
Where appropriate and legally required, Users will be provided with applicable notices or remedies.
Termination does not eliminate obligations or rights that arose before termination.
15. Third-Party Services
The Website may rely on third-party services for functions including learning management, hosting, payments, communications and analytics.
We are not responsible for independent third-party websites or services that are outside our control.
Your use of those services may also be subject to their respective terms and privacy policies.
16. Website Availability
We strive to maintain reliable access to the Website and Services but cannot guarantee uninterrupted or error-free operation.
Temporary interruptions may occur because of maintenance, technical failures, third-party service interruptions, security incidents or circumstances outside our reasonable control.
Where an interruption materially prevents delivery of a purchased Service, we will address the situation in accordance with applicable law and the circumstances involved.
17. No Guarantee of Professional or Financial Results
Daho Collective does not guarantee employment, income, business success, client acquisition, professional advancement or any particular financial or career result from completing a certification, program or Service.
Results depend on numerous factors outside our control, including the individual’s experience, effort, qualifications, market conditions and applicable professional requirements.
18. Limitation of Liability
To the maximum extent permitted by applicable law, Consultation DMT Inc. and Daho Collective will not be liable for indirect, incidental, special or consequential damages arising from use of the Website or Services.
Any limitation or exclusion of liability contained in these Terms applies only to the extent permitted by applicable law.
Nothing in these Terms excludes or limits liability or consumer rights where such exclusion or limitation is prohibited by applicable Quebec or Canadian law.
This is much safer than your current Clause 20, which literally contains the unfinished sentence “Nothing in these Terms and Conditions excludes or restricts .”
19. Privacy
Our collection, use, disclosure and protection of personal information are governed by the Daho Collective Privacy Policy, as amended from time to time in accordance with applicable law.
The Privacy Policy should be made available on the Website.
20. Electronic Communications
By creating an Account or purchasing a Service, you consent to receiving electronic communications reasonably necessary to administer your Account, transactions, certification and Services.
Marketing communications will be sent in accordance with applicable law and applicable consent requirements.
You may unsubscribe from promotional communications through the unsubscribe mechanism provided in those communications.
21. Changes to Services
We may update or improve the Website, educational materials and Services over time.
We may also correct errors or make changes necessary for legal, security, educational or operational reasons.
Material changes affecting an existing purchase will be handled in accordance with applicable law and the terms applicable when the purchase was made.
22. Changes to These Terms
We may update these Terms periodically.
The current version will be posted on the Website together with its effective or “Last Updated” date.
Changes will apply prospectively except where applicable law permits or requires otherwise.
Where legally required, we will provide additional notice or obtain consent regarding material changes.
23. Severability
If any provision of these Terms is determined to be unlawful, invalid or unenforceable, that provision will be interpreted or limited to the extent necessary to comply with applicable law.
The remaining provisions will continue to apply to the extent permitted by law.
24. No Waiver
Failure by Daho Collective or Consultation DMT Inc. to enforce a provision of these Terms on one occasion does not constitute a waiver of that provision or our right to enforce it subsequently.
25. Governing Law and Jurisdiction
These Terms and your use of the Website are governed by the laws applicable in the Province of Quebec and the federal laws of Canada applicable therein, without limiting any mandatory consumer rights or jurisdictional protections that apply under law.
Any dispute will be addressed before a court or other competent authority having jurisdiction under applicable law.
26. Language
These Terms may be made available in English and French.
Where applicable, the parties’ choice of language and the presentation and execution of consumer contracts will be handled in accordance with the language requirements applicable in Quebec.
This section deserves particular attention before launch. Quebec’s consumer-protection guidance states that contracts required to be in writing under the Consumer Protection Act must generally be drawn up clearly in French, with another-language version possible under the applicable conditions. For contracts on a technological medium, the entire contract may also need to be disclosed without requiring the consumer to access it through an external hyperlink.
